This Indenture and conveyance made and entered into this 9th day Oct. 1871 between Wm. H. and J. N. Ellaby by Casper Herps Commissioner parties of the first part, and Mary R. Jones, party of the second part. Whereas, a Petition was filed in the Bullitt County Court, on the 10th day April 1871 by the parties of the first part, and Hazel Tucker guardian for said Mary R. Jones for the purpose of making a divission [sic] of a tract of land known as the Noah Jones farm lying in Bullitt County KY on the road leading from Mt. Washington to Shelbyville said Ellabys owning one Moity in said farm by purchase as shown by Deed filed in the suit for divission, and said Mary R. Jones is entitled to the other Moity as heir at Law of Noah Jones dec'd and at July term of said Court, the Court appointed, Charles Carithers, Westly Drake, and Casper Herps Commissioners to make said divission, and on the 25th day of July said Com'rs met on said land and proceeded and divided the same, and at the August term of said Court, ssaid Com'rs filed their report of the divission in Court, all parties interested in same divission, having certified in said Com'rs report that the divission was satisfactory to them, ask the Court to confirm said report, and have the same recorded, and at the same Court, Casper Herps was appointed a Com'r for and on behalf of the parties of the first part, to convey to the party of the second part, her divided interest in said land, as laid off and allotted to her by the aforesaid com'rs and designated in said Commissioners report as lot No. 2. Now therefor for and in consideration of the Petition filed Com'rs report filed and recorded the said Wm. H. and J. N. Ellaby by C. Herps Com'r hereby grant, covenant and convey to the party of the second part, said lot No. 2. which is bounded as follows Beginning at an Ash stump & Sugartree B on plat corner to Mathew Smock, thence N 80 W 245 poles to a Prim Oak & fallow Buckeye, Markwells corner, thence S 11 for 10 W 119 poles to a stone, old Call or white & black Oaks saplings in a line of Kings 1000 acres, thence with the same S 82 E 227 poles to a Poplar, corner to Owens 400 acres survey, now Markwells & Mrs. Kings corner, thence S 85 E 37 poles to a stake, corner to Eliza A. Allens dower, which was laid off in the within Noah Jones tract by former Commissioners, thence with her dower ilne N 39 3/4 E 64 1/4 poles to a stone in the Shelbyville road in said line, divission corner to said Ellabys lot, thence with the same N 69 W 51 poles to a stone, thence N 10 E 40 poles to the Beginning. Containing 186 1/2 acres.
To have and to hold the aforesaid tract of land unto the said Mary R. Jones her heirs and assigns forever against the claims of said Wm. H. & J. N. Ellaby their heirs and assigns, and against the claims of all other Persons, as fully as by Law said Com'r can warrant.
