Mittie DODD KINGSLEY is my Great Grandmother. Anthony DODDs is Mittie's 2nd Great Grandfather and my 4th Great Grandfather.
WARRANTY DEED: GRATTAN B. CROWE & WIFE TO MITTIE E. KINGSLEY
This indenture witnesseth: That Grattan B. CROWE and Grace F. CROWE, his wife of Harrison County in the State of Indiana, for and in consideration of the sum of One Dollar [$1.00] receipt of which is hereby acknowledged, convey and warrant to Mittie E. KINGSLEY, of Harrison County, in the State of Indiana, all that part of tract of land hereinafter described that lies south of the public road that runs east and west across said tract of land, being twenty six acres more or less, said whole tract of land being described as follows, to-wit:
The following real estate in Harrison County, State of Indiana, Designated as Lot number three [3] in the partition of the lands of Anthony DODDS, deceased of the southwest quarter of section four [4] in township six [6] south of range four [4] east, commencing forty one [41] poles east of the northwest corner of said quarter section, running thence east thirty nine [39] poles to a stake or stone; thence south one hundred and ten, [110] poles to a stake or stone; thence west thirty nine[39] poles to a stake or stone; thence north one hundred and ten [110] poles to the place of beginning containing twenty-six [26] acres, and one hundred and thirty [130] poles. Also seventeen and one third [17 1/3] acres out of the same section, Township and range bounded as follows, to-wit: beginning at the south east corner of a tract of land formerly owned by John BYRUM, running thence north with said land fifty [50] poles; thence east fifty four [54] poles and thirty six and one half [36 1/2] links; thence south fifty [50] poles thence west fifty four [54] poles, and thirty six and one half [36 1/2] acres, more or less and being the same land deeded by John E. FEREE and wife, to Andrew JOHNSON, and Recorded May 31, 1870, excepting and excluding from this conveyance all the Oil and Gas and any and all minerals of every kind and character that lie in said real estate and under and beneath its surface, the grantor retaining full and complete right or ingress and egress to and from said real estate for himself his servants, agents, employees, successors and assigns to erect, derricks maintain drilling rigs, pipe lines pumps, tanks, and all necessary tools and equipment upon the surface of said real estate, for the purposes of drillings for exploring for, removing, and marketing from said real estate, said Oil and Gas and with full right to maintain on said real estate, any and all necessary tools and equipment to remove therefrom and market any and all minerals that might lie beneath the surface thereof. It is the intention of the grantors herein and by this conveyance said grantors do convey to the grantee all the real estate described herein as a part of the tract described herein that lies south of the public road crossing the same east and west, except the mineral rights in said real estate so conveyed, to which mineral rights the grantors retain full and complete title.
